Welcome to Lingoviax ("Lingoviax", "we", "us", or "our"), a service operated by ATLAS BUILDINGS WORKS LIMITED ("Company", "we", "our", or "us"). These Terms of Use ("Terms") govern your access to and use of the Lingoviax website, applications, APIs, and related services (collectively, the "Service").

By creating an account, purchasing credits, accessing, or using the Service, you agree to be legally bound by these Terms. If you do not agree, you must not use the Service.

1. About the Service

Lingoviax is an AI-powered language translation and communication platform that enables users to translate text and other supported content using artificial intelligence models and related technologies.

Lingoviax operates on a pay-as-you-go credit system.

The Service does not require or offer recurring subscriptions. Users purchase credits individually, and those credits are consumed when using the Service.

Lingoviax may utilise artificial intelligence models and services provided by third-party providers. We provide the interface, infrastructure, billing, and account management; we do not own or operate the underlying AI models.

2. Eligibility

You must:

• be at least 18 years old (or the age of majority in your jurisdiction);
• have legal capacity to enter into binding contracts; and
• provide accurate registration information.

By creating an account you confirm that you satisfy these requirements.

3. Your Account

You are responsible for:

• maintaining the confidentiality of your login credentials;
• all activity occurring under your account;
• keeping your information accurate and up to date.

You must notify us immediately if you believe your account has been accessed without authorisation.

We may suspend or terminate accounts where we reasonably believe unauthorised access or misuse has occurred.

4. Purchasing Credits

The Service operates solely using prepaid credits.

Credits:

• are purchased as one-time transactions;
• are deducted as Services are used;
• have no cash value;
• cannot be transferred between users unless expressly permitted by us.

Pricing may change at any time. Changes only apply to future purchases.

Unused credits remain available unless otherwise stated or where your account is terminated in accordance with these Terms.

5. No Subscription

Lingoviax does not operate recurring subscriptions.

Purchases are individual prepaid credit purchases only.

You will never be automatically billed for future credit purchases.

6. No Refund Policy

All purchases are final.

To the fullest extent permitted by applicable law:

• credits are non-refundable;
• partially used credits are non-refundable;
• unused credits are non-refundable;
• mistaken purchases do not qualify for refunds.

Because credits provide immediate access to digital services and computing resources, you acknowledge that your right to cancel or withdraw may be waived where permitted by law.

Nothing in these Terms limits statutory rights that cannot legally be excluded.

7. Acceptable Use

You agree not to use Lingoviax to:

• violate any law or regulation;
• infringe intellectual property rights;
• upload malicious software or harmful code;
• generate spam or fraudulent content;
• harass, threaten, abuse, or intimidate others;
• generate unlawful or harmful material;
• interfere with the operation or security of the Service;
• attempt unauthorised access to any systems;
• reverse engineer the Service except where legally permitted.

We may suspend or terminate accounts that violate these Terms.

8. User Content

You retain ownership of the content you submit.

By submitting content to Lingoviax you grant us a limited licence to:

• process your content;
• transmit your content;
• translate your content;
• store your content where necessary;
• provide and improve the Service.

This licence exists solely for operating the Service.

You are responsible for ensuring you have the necessary rights to any content you upload.

9. AI Translation Disclaimer

Translations generated by artificial intelligence are automatically produced.

Although Lingoviax aims to provide high-quality translations:

• translations may contain errors;
• context may not always be interpreted correctly;
• cultural nuances may be missed;
• legal, medical, financial, or technical translations should always be independently reviewed.

You are solely responsible for verifying translations before relying upon them.

Lingoviax does not guarantee the accuracy, completeness, or suitability of AI-generated translations.

10. Third-Party AI Providers

The Service may rely upon artificial intelligence technologies provided by third parties.

These providers may change over time without notice.

We are not responsible for:

• outages affecting third-party providers;
• changes in model behaviour;
• removal of model features;
• delays caused by external providers.

11. Service Availability

We aim to provide reliable service but cannot guarantee uninterrupted availability.

The Service may occasionally be unavailable due to:

• maintenance;
• software updates;
• infrastructure failures;
• third-party outages;
• events outside our reasonable control.

We are not liable for temporary interruptions.

12. Intellectual Property

The Service, including:

• designs;

is owned by or licensed to us and protected by intellectual property laws.

These Terms do not transfer ownership of any intellectual property to you.

To the fullest extent permitted by law, we shall not be liable for:

• indirect damages;
• consequential damages;
• loss of profits;
• business interruption;
• loss of revenue;
• loss of goodwill;
• loss of data;
• reliance on AI-generated translations.

Where liability cannot legally be excluded, our total liability shall not exceed the total amount paid by you to Lingoviax during the twelve (12) months preceding the event giving rise to the claim.

15. Indemnity

You agree to indemnify and hold harmless Lingoviax, its directors, officers, employees, affiliates, and partners from any claims, liabilities, damages, losses, or expenses arising from:

• your misuse of the Service;
• your breach of these Terms;
• your violation of applicable laws;
• your infringement of another person's rights.

16. Suspension and Termination

We may suspend or terminate your access where:

• you breach these Terms;
• fraudulent activity is suspected;
• payment fraud occurs;
• continued access presents legal or security risks.

Termination does not entitle you to any refund.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, unless applicable consumer protection laws provide otherwise.
